Medical Power of Attorney

This document is designed to protect your person. It is usually just a short-term solution while you are incapacitated and unable to make decisions for yourself. This is because you are always in charge of your own health care while you are conscious and mentally competent. But this power of attorney can help during an emergency. This power of attorney activates, generally, only when you are ill or injured and unable to make decisions for yourself about your health care.

 

This power of attorney authorizes your chosen agent to choose, engage and fire health care providers for you, as well as to make decisions about your health care—whether you will have a surgery, whether you will be cared for in a hospital or residential treatment facility, for example.

 

Statutory Durable Power of Attorney

This document enables your designated agent to handle non-medical matters for you if you are temporarily, or are in the long-term, incapacitated. You are able to specify exactly what powers your agent will have, place limits on those powers and, generally, and permit your agent to handle your money, businesses, etc. while you cannot. As with the medical power of attorney, this power of attorney is generally only activated when you are incapable of handling your own affairs and that fact is certified by a medical professional.

 

Appointment of Agent to Control Disposition of Remains

This document helps with an issue that, if only addressed in a Will, will often be overlooked and never given effect. This appointment allows the planner to determine for herself how her body will be disposed of – i.e., burial or cremation, the cemetery where she will be buried, where her ashes will be spread if cremated, what type of service she wishes to have to mark her death, etc.

Sometimes, such decisions can lead to unhealthy family fights. This is especially true when the decedent and his loved ones have different values, religious beliefs, etc.

This document can also address where the money will come from to enable your wishes to be carried out.
